The Panel of the Court of Appeals composed of two EULEX judges and one local judge, with EULEX judge presiding issued the judgment dated 22 June 2017 in the case of Xh.K. – PAKR 648/16.
The appeals were filed both by the defence counsel and by the SPRK. The Court of Appeal partially amended the judgment of the Basic Court of Mitrovicë/Mitrovica P no 185/15 of 8 August 2016 by reclassifying the crimes that the accused was convicted for as war crimes against individual persons instead of war crimes against civilian population. The impugned judgement was upheld with relation to the acquittal for a murder charge.
The aggregate punishment of 8 (eight) years imprisonment imposed against the defendant by the Basic Court of Mitrovicë/Mitrovica, respectively fine of euro 1.500 (one thousand five hundred), is amended to 7 (seven) years of imprisonment and a fine of euro 1200 (one thousand two hundred).
